- Engagement and Scope: These Terms and Conditions apply to all services carried out by M-Electrics unless otherwise agreed in writing. Scope is subject to change based on site conditions and client instructions.
- Sunset Clause: Projects must be substantially completed within 6 months from commencement. If delayed beyond this through no fault of M-Electrics, we may withdraw without penalty or further obligation.
- Parking and Site Access: Client must provide reasonable onsite parking. If not available, parking costs incurred by M-Electrics will be charged to the client.
- Patching and Finishes: M-Electrics is not responsible for patching, painting, or repair to surfaces unless agreed to in writing. No backcharges will be accepted for these items.
- Payments and Overdue Accounts: Invoices are payable in accordance with the agreed payment terms. If payment is overdue by more than 7 days, M-Electrics reserves the right to suspend all works without notice. If payment remains outstanding for more than 21 days, M-Electrics may terminate the contract and/or isolate power to the entire project at our discretion. All amounts invoiced will remain due and payable in full, regardless of contract termination. Any and all costs associated with debt recovery, including legal fees and third-party collection agency charges, will be added to the outstanding balance and passed on to the client.
- Variation and Additional Works: Any verbal or written change to the scope is a variation and may attract additional charges. Variations must be confirmed in writing.
- Subcontract Agreement: These Terms act as the subcontract agreement. Any engagement or instruction to proceed is acceptance of these Terms.
- Limitation of Liability: M-Electrics is not liable for delays or damages from events beyond control. Liability is limited to rectification of defective work under applicable warranties.
- Dispute Resolution: Disputes must first be attempted to be resolved through negotiation before any legal action is pursued.
- Concealed Services: M-Electrics will take care to avoid damage to concealed services but is not liable for damages unless services are clearly marked before works commence.
- Utility Headworks Fees: All headworks or infrastructure upgrade fees charged by utilities (including but not limited to Western Power, NBN, or Synergy) are to be paid by the client or project owner. These fees are not included in M-Electrics pricing unless expressly stated in writing.
- Responsibility for Theft and Damage: The client is responsible for all theft, vandalism, or damage to any M-Electrics materials, equipment, or completed works on site—whether partially completed or finished.
- Trenching and Ground Conditions: Trenching has been priced for soft soil only. If hard rock or unforeseen obstructions are encountered, additional charges will apply as a variation, including costs for specialised equipment. Removal of excess sand is to be carried out by others. Final compaction of trenches must be completed by others unless otherwise agreed in writing.
- Quote Acceptance: The client may accept the quote by completing the acceptance form at the bottom of the quote (preferred), or by providing written or verbal confirmation to proceed, including via email, text message, or phone call. Commencement of works will be taken as acceptance of all terms outlined in the quote and associated Terms & Conditions.
